1. About Den Argao
Den Argao is a Berlin-based Filipino artist whose practice centers on Baybayin-inspired textured acrylic paintings, blending modern art and cultural heritage.
Through this Website, Den offers original artworks, limited-edition prints, custom commissions, event-based calligraphy services, and the Monthly Mail Club, all under the larger vision of the Guardian of Memory movement — an initiative dedicated to preserving Filipino heritage through art, storytelling, and collective guardianship.

2. Offerings
The Website provides the following products and services:
- Original Textured Paintings – one-of-a-kind artworks created by Den Argao.
- Limited Edition Prints – archival-quality reproductions, signed, numbered, and dry-sealed.
- Custom Commissions – personalized works including Baybayin Name Art and Baybayin Manuscript Commissions created through direct agreement.
- Monthly Mail Club – a subscription-based mail experience offering art prints, letters, and surprises.
- Guardian of Memory Membership Tiers – collectible badges and exclusive access levels for supporters.
- Digital Content – including images, stories, and downloadable materials protected by copyright.
- Baybayin Name Art – personalized name inscriptions created by the artist.
- Baybayin Manuscript Commissions – quotes, verses, mantras, or personal messages translated and created in Baybayin.
- Live Baybayin Calligraphy – on-site calligraphy experience for events, where names are handwritten live.
3. Ordering and Payments
3.1 Website Orders (Stripe)
Products and services available for direct purchase on the Website — including Limited Edition Prints, Baybayin Name Art, and Monthly Mail Club subscriptions — may be purchased through Stripe.
By placing an order through Stripe, you confirm that all information provided is accurate and that you have the legal right to use the payment method submitted.
All payments are processed securely through Stripe, and orders are considered confirmed once payment is successfully completed.
By completing a purchase, the buyer agrees not to initiate unjustified chargebacks and to contact the artist first to resolve any issue.
3.2 Originals, Commissions, and Event Bookings
Original artworks, Baybayin Manuscript Commissions, and Live Baybayin Calligraphy event bookings are not processed through the standard website checkout due to their customized and variable nature.
Interested clients must contact the artist directly via email to request availability, pricing, payment terms, and project details.
The artist reserves the right to accept or decline any request at her discretion, including for safety, legal, or artistic reasons.
The artist reserves the right to refuse or ignore any request that appears inappropriate, unsafe, or personally intrusive.
Payment terms for these services will be communicated and agreed upon during direct correspondence.
By completing a purchase, the buyer agrees not to initiate unjustified chargebacks and to contact the artist first to resolve any issue.

3.3 Taxes and Fees
Applicable taxes, including VAT where required, will be clearly indicated during the checkout process for all applicable products and services purchased through the Website.
These charges are not included in the purchase price and are the responsibility of the buyer.
Buyers are responsible for any customs duties, import taxes, or additional fees applicable in their country.
3.4 Order Refusal
Den Argao reserves the right to refuse or cancel any order, booking, or request for products or services offered through the Website, if necessary for safety, legal compliance, or other justified reasons.
In such cases, any payment received will be fully refunded to the original payment method.
4. Shipping and Delivery
Artworks are shipped from Berlin, Germany, and handled with care.
Originals & Commissions: Photos and tracking are shared once shipped.
Limited Edition Prints: Packaged in archival wrapping and shipped in a rigid mailer or tube.
Monthly Mail Club: Shipped with stamps (no tracking) between the 22nd–26th of each month.
Buyers are responsible for providing accurate shipping information.
If an order is returned due to an incorrect address or failed delivery, reshipping costs will be the responsibility of the buyer.
Estimated delivery times:
Germany – within 7 business days after dispatch
International – 10–21 business days (depending on customs and carrier)
Delivery times are estimates and not guaranteed.
Buyers are responsible for any customs duties, import taxes, or additional fees applicable in their country.
Once shipped, responsibility transfers to the carrier. The artist will assist in filing claims where possible but is not responsible for delays, loss, or damage caused by the shipping provider.
5. Refunds and Cancellations
Each piece is carefully created and documented for authenticity. Due to the nature of original and custom artwork, specific refund conditions apply as outlined below.
Original Artworks:
Original artworks are final sale due to their unique nature and the care invested in creating each piece. However, your trust matters to me.
If your artwork arrives damaged, please contact me within 72 hours with photos so I can assist you with repair, replacement, or a claim through shipping insurance.
Limited Edition Prints:
Refunds are only offered for damaged or lost shipments verified through shipping insurance.
Monthly Mail Club:
Subscriptions can be cancelled before the next billing date. Cancelling your subscription does not entitle you to a refund; it only prevents future charges.
You will still receive your last paid month’s Mail, but no further shipments will be made unless you re-subscribe.
Custom Works (Baybayin Name Art & Manuscript Commissions):
Due to the personalized nature of these works, all sales are final.
Once work has begun, payments are non-refundable.
If a project is cancelled before work begins, a refund may be issued at the artist’s discretion.
Custom works are created based on the client’s request and the artist’s interpretation. Refunds will not be issued based on personal preference, change of mind, or subjective expectations once the work has been started or completed.
6. Right to Decline or Cancel Orders
Den Argao reserves the right to decline, cancel, or refund any order, booking, request, subscription, or membership at its sole discretion.
This includes—but is not limited to—cases that may compromise the artist’s personal safety, privacy, well-being, or the integrity of the work.
In such cases, a full refund will be issued (if payment has been received), and the transaction will be terminated without further obligation.
This clause exists to protect the artist’s safety and to ensure that the Guardian of Memory community remains a respectful and safe space.
7. Custom Work and Commissions
Custom works include Baybayin Name Art and Baybayin Manuscript Commissions. These are created on a made-to-order basis and are unique to each client.
By placing an order, the client agrees to the artist’s creative interpretation and style.
The artist will make reasonable efforts to communicate clearly and deliver work in alignment with agreed expectations.
Process overview (for commissions and manuscripts):
- Initial contact and concept sharing
- Agreement on artwork details (size, materials, timeline, and pricing)
- 50% deposit required to begin (unless otherwise stated)
- Progress updates may be shared at the artist’s discretion
- Final balance due before shipping
By proceeding with the order, the client acknowledges and accepts the artist’s style, and no refunds will be issued based on stylistic interpretation.
Due to the personalized nature of the work, payments are non-refundable once the work has begun.
Minor adjustments may be accommodated; however, major revisions or changes in direction may incur additional fees or may not be accepted.
If the final balance is not completed within a reasonable timeframe (typically 14 days unless otherwise agreed), the artist reserves the right to cancel the project without refund of the deposit.
All commissioned works remain the intellectual property of Den Argao unless otherwise agreed in writing. Ownership of the physical artwork does not transfer copyright or reproduction rights.
8. Live Baybayin Calligraphy (Events)
Live Baybayin Calligraphy is offered for private and public events, including weddings, cultural events, and corporate gatherings.
Bookings and Availability:
Event bookings require advance confirmation and a non-refundable booking fee to secure the date.
Scope of Service:
The number of names completed during the event depends on time, guest volume, and event conditions. No minimum number of completed names is guaranteed. The service is time-based and not output-based.
The artist is not responsible for reduced output due to delays, interruptions, or conditions beyond her control during the event.
Fees and Extensions:
Travel fees may apply for locations outside Berlin, Germany.
Any extension of booked time may incur additional charges.
Cancellations and Refunds (Events):
Booking fees are non-refundable, as they secure the artist’s time and availability.
In case of cancellation by the client, any payments made may be partially refunded at the artist’s discretion, depending on the timing of the cancellation.
In case of unforeseen circumstances preventing the artist from attending, a full refund of the booking fee will be issued.
In case of unforeseen circumstances causing delays, the artist will communicate updates and adjust timelines accordingly.
Limitation of Liability (Events):
The artist is not liable for event cancellations or disruptions caused by circumstances beyond her control, including but not limited to venue issues, weather conditions, or force majeure events.
9. Certificates of Authenticity (COA)
Each Original Artwork, Commission, and Limited Edition Print includes a hand-signed Certificate of Authenticity (COA).
The COA features:
- a unique artwork code
- a dry seal
- the artist’s signature
- a digital layer for provenance tracking
The COA confirms the authenticity and provenance of the artwork and certifies your role as part of the Guardian of Memory movement.
The COA must be kept by the collector as proof of authenticity. The artist is not responsible for lost, damaged, or misplaced certificates, and replacement may not be guaranteed.
10. Guardian of Memory and Monthly Mail Club
Becoming a Guardian of Memory represents a symbolic commitment to preserve heritage and protect what time tries to forget.
Each tier carries meaning:
- Golden Badge – Originals & Commissions
- Silver Badge – Limited Edition Prints
- First Badge – Monthly Mail Club
Memberships and subscriptions are non-transferable.
Any misuse, harassment, or attempt to contact the artist through these programs for non-art-related or personal matters may result in termination of the membership or subscription at the artist’s discretion.
In such cases, refunds may be issued at the artist’s discretion, depending on the circumstances.
The artist reserves the right to modify or discontinue any tier, benefit, or subscription at any time.
11. Digital Content and Intellectual Property Protection
All content on www.denargao.com — including images, artworks, text, downloadable files, and videos — is the property of Den Argao and is protected under German and international copyright laws.
No content may be copied, reproduced, edited, distributed, transmitted, or used in any form for commercial or personal purposes without prior written permission from the artist.
Use of AI tools, image tracing, scraping, or any form of reproduction technology to replicate, imitate, or derive from the artist’s work, style, or textures is strictly prohibited.
Ownership of any physical artwork does not grant the right to reproduce, distribute, or commercially exploit the work.
Legal action may be taken against any individual or entity that misuses or unlawfully reproduces the artist’s intellectual property.
This protection ensures that each piece remains authentic and traceable to the artist.
12. Privacy and Data Protection (GDPR)
All personal data collected — including name, address, and email — is processed in compliance with the EU General Data Protection Regulation (GDPR) and applicable German data protection laws.
Data is collected and processed for the following purposes:
- Processing and fulfilling orders
- Managing subscriptions and memberships
- Communicating with customers regarding orders or inquiries
- Sending updates or newsletters (only with prior consent)
Personal data will not be sold or shared with third parties, except where necessary to fulfill services (e.g., payment processors or shipping providers).

13. Limitation of Liability
While all reasonable efforts are made to ensure the quality and accuracy of products and services, Den Argao is not liable for:

- loss or damage caused by shipping carriers after dispatch
- misuse, improper handling, or storage of artworks by recipients
- indirect, incidental, or consequential losses
All products and services are provided “as is,” without warranties beyond those required by applicable law.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany.
Both parties agree to attempt to resolve any disputes amicably and in good faith before pursuing legal action.
If legal action is required, jurisdiction shall lie with the competent courts of Berlin, Germany.
